The rule, part of a broader legislative package and revised by Senator Ted Cruz, would penalize states seeking to regulate AI by withholding federal broadband funding. While the measure cleared a key parliamentary hurdle making it filibuster-proof, there is still notable opposition from some Republicans concerned about states’ rights. Without a federal regulatory framework to replace state laws, critics warn this could leave a significant policy gap regarding AI oversight. Several states have already taken or are considering their own action to regulate AI.
